Briefing – International Agreements in Progress: EU–UK agreement on Gibraltar – 02-07-2026

The agreement between the European Union (EU) and the United Kingdom (UK) in respect of Gibraltar would complete the legal framework of the relations between the EU and the UK established by the Trade and Cooperation Agreement (TCA). The status of Gibraltar, not covered by the TCA, has been negotiated between the EU, Spain, the UK and Gibraltar since October 2021. The negotiations concluded in June 2025 with a broad agreement that introduces a hybrid governance model with roles for all four parties taking part in the negotiations. The agreement integrates Gibraltar into the Schengen area and provides for a customs union. It eliminates physical border controls with Spain, boosts Gibraltar’s economic links with Spain and the EU, and introduces dual border checks at Gibraltar’s port and airport. It also allows for direct flight connections between Gibraltar and the EU. After the agreement’s legal review and translation, it will be presented to the Council for final signature. It will then be submitted to the European Parliament for consent. The indicative plenary sitting date is set for 14 December 2026. The Council has authorised a provisional application of the agreement from 15 July 2026.
