The original full study examines the regulations, instruments and practices for enforcing the key digital legislative acts that form the “Digital Rulebook” aimed at adapting the Digital Single Market to technological change, promoting innovation and, at the same time, mitigating risks. To date, (almost) all these legal acts include elementary but uncoordinated provisions on private law remedies and public law sanctions. The study highlights the numerous resulting gaps, overlaps, and inconsistencies that hinder enforcement.
